Overview
Companies that design and manufacture products have a responsibility to make sure that their products are free from defects and not unreasonably dangerous. A product must be fit for its intended purpose. Sometimes, fault can be established by showing that a company could foresee that a product would be used in a way that was not intended.
Companies that may be responsible in a products liability case are the manufacturer, designer, wholesaler or retailer. These companies are all part of the supply chain, and depending on the circumstances, one or all of them may be brought into a case. They all have an obligation to place safe products into the market.
Many injuries can happen as a result of a defective product, and the items of recovery are the same as other areas of personal injury. An injury victim may collect for medical bills, pain and suffering, lost earnings, and many more losses depending on the situation.
